Training Course: Takaful Insurance and Contract Drafting in Practice

1Summary

Drafting an insurance contract that is both legally sound and Shariah-compliant is a narrower skill than most legal training covers — it means understanding gharar, riba, and mutual responsibility well enough to write terms that hold up in both a court and a Shariah board review. That gap is exactly what this programme closes.

Delivered by the Arab British Fellowship Training Academy, the course takes participants from the founding principles of takaful insurance through to the organisational structure of takaful companies, the types of policies they issue, and the full lifecycle of a contract — drafting, execution, claims, and dispute handling — with the legal and regulatory requirements built in at every stage.

Module 1: Foundations and What Sets Takaful Apart

  • Defining insurance and its economic and social role, then tracing how takaful insurance developed historically.
  • The Shariah and jurisprudential grounds that separate takaful from conventional insurance, including gharar, riba, and gambling provisions.

Module 2: Inside a Takaful Company

  • Governance through the board of directors and the Shariah supervisory board.
  • The participants' fund and the company's financial structure.
  • Whether the company operates on a fee basis or through Mudarabah profit-sharing.

Module 3: Products and Policy Components

  • The main types of takaful cover: life, health, accident, and marine/aviation/commercial insurance.
  • What a takaful policy is built from — key data, general and specific terms, exclusions, and the obligations of each party.

Module 4: From Application to Signed Contract

  • Submitting an application and running the actuarial assessment.
  • Issuing the policy and setting coverage, then managing the relationship for the life of the contract.
  • The legal characteristics of an insurance contract, its treatment as a contract of adhesion, and liability in case of breach.

Module 5: Risk and Claims in Practice

  • Retakaful mechanisms and how risk gets distributed collectively.
  • The link between risk management and how a policy is priced.
  • Reporting an incident, gathering the required documents, and settling compensation under Shariah-compliant insurance.
