Administrative Decision-Making Training Course: Legal Foundations and Judicial Review

1Summary

Every administrative decision carries real legal weight — it can create rights or impose obligations simply because the administration acts in the public interest. But that power only holds up if the decision is properly formed, and if it can be told apart from other government acts such as legislative or judicial work. This course starts from that distinction, since telling these apart is exactly what determines whether a decision is open to judicial review.

From there, participants examine what actually constitutes a valid administrative decision — its pillars of jurisdiction, form, subject matter, cause and purpose — and how these hold up when the decision is challenged in court. The programme pairs this legal grounding with practical contract-drafting and legal-memo skills, so participants leave able both to issue sound administrative decisions and to document them correctly.

Module 3: Writing Memoranda That Hold Up

  • Applications and examples in writing legal memoranda, and skills and methods of legal drafting.
  • Formulating documents, memos and statements of various types.

Module 4: Negotiating and Closing Contracts

  • Contract preparation and conclusion skills.
  • Negotiation and dispute-resolution skills, and persuasion techniques.

Module 5: Specifications, Tenders and Legal Risk

  • Writing and analysing contract specifications and procurement processes.
  • The legal importance of specifications and their relation to the "invitation to tender" process, doubtful and deficient specifications, different types of specifications and related risks, and the impact of language on contractual terms and legal conditions.
