Cross-Border Commerce and International Trade Law (Online / Remote)

1Summary

Cross-border deals do not run on goodwill alone — they run on a dense web of conventions, national statutes and dispute-resolution mechanisms that decide who wins when a shipment is late or a payment is disputed. Anyone negotiating, drafting or enforcing an international contract needs to know how that framework actually works, not just that it exists.

Arab British Fellowship Training Academy built this programme to walk participants through that framework from the ground up: how trade agreements are negotiated and applied, how commercial contracts are structured and protected, and how disputes are actually resolved when the parties cannot agree. By the end, participants will be able to read a cross-border contract critically, flag the legal risks in it, and understand the mechanisms available to enforce or contest it.

  • The economic and political impact of international trade on modern legal systems.

Module 2: Trade Agreements and the Bodies That Enforce Them

  • The World Trade Organization (WTO) and its role in global trade.
  • UNCITRAL and other regulatory bodies shaping international commercial law.
  • Key agreements: the 1958 Geneva Convention, the CISG, and bilateral and free trade agreements.

Module 3: Structuring International Commercial Contracts

  • Types of contracts: sales, transport, and financing agreements.
  • Understanding and negotiating Incoterms and contract terms.
  • Guarantees, obligations, and drafting with the negotiation process in mind.

Module 4: Documentation, Customs and Transport

  • Preparing commercial documents such as invoices, certificates and banking documentation.
  • Customs laws, import/export regulations, duties and clearance procedures.
  • International transport law: CIM, CMR, Bill of Lading, and container, sea and air freight regulations.

Module 5: Insurance in Cross-Border Trade

  • Types of insurance covering international transport and goods.
  • Managing risk exposure and insuring against loss.
  • Compensation and settlement mechanisms in trade insurance.

Module 6: Resolving International Trade Disputes

  • Arbitration, mediation and conciliation as alternatives to litigation.
  • National and international courts specialized in trade disputes, and how to select the right forum.
  • The New York Convention and dispute-resolution mechanisms built into free trade agreements.

Module 7: E-Commerce and Intellectual Property in Global Trade

  • How e-commerce is reshaping international legal systems, data protection, and consumer protection online.
  • Laws governing electronic transfers and cross-border online trade.
  • Protecting trademarks, inventions and intellectual property in international trade agreements.
