E-contracts do not differ from ordinary binding contracts in structure, formation, type or content — they remain governed by the general provisions of contract law — yet legislators have never given this contract type its own dedicated regulatory category.

Article II of the European regulation on consumer protection defines remote contracts as agreements or service arrangements concluded through one or more electronic means of communication until the contract is finalized. Because most e-contracts operate internationally, some scholars define international e-commerce contracts as a distinct category: agreements in which goods and services move between people in different countries through modern technology.
