Employer Liability Essentials: A Training Course on Legal Risk and Workplace Responsibility (Online / Remote)

1Summary

Managers without a legal background are still expected to make decisions every day that carry real legal weight — how a dispute with an employee is handled, what a contract of employment implies, or where liability sits when something goes wrong at work. This intensive course is built specifically for non-lawyers who deal with staff and their representatives on a regular basis, giving them a clear route through employer liability law without the jargon.

The course also situates that legal grounding within a broader risk-management approach — how to identify, measure and reduce the risks an employer relationship creates, and the safeguards that keep both the organisation and its people protected.

2Objectives and target group

By the end of this course, participants will be able to:

  • Understand the basis of general law governing the employer-employee relationship.
  • Analyse the general-law factors that affect employer responsibilities.
  • Distinguish between general law and basic (statutory) law.
  • Trace the history of legal cases dealing with employer liability.
  • Understand duty-of-care obligations and the basis of contract law.
  • Compare employer liability with sound legal opinion, and discuss it with peers from other industries.

Module 2: General Law, Contracts and the Basis of the Relationship

  • Basic law versus general law, and general law as the basis of the contract.
  • Types of contracts, and ways of carrying out the work.
  • The master/servant relationship, and legal obligations between employer and employee.

Module 3: Duty of Care and Employer Responsibility in Practice

  • Duties of care under general law.
  • The importance of employment relationships.
  • General-law factors that affect employer responsibilities.

Module 4: Risk Assessment for Employer Liability

  • Methods of risk assessment, and precautions to avoid risk.
  • The relationship between risk and institutional policies and procedures.
  • Reasons for assessing risk, and methods of certifying risk assessment and precautions.
  • Methods of dealing with corruption-related risk, and the right timing for precautions.
  • Risk-assessment categories and field work.
