When an employee is accused of a violation, two very different forces come into play: the administration's right to discipline, and the judiciary's role in guaranteeing a fair process. Between Administration and Judiciary, a Training Course from the Arab British Fellowship Training Academy, is built around that tension — equipping participants to apply disciplinary authority correctly while respecting every safeguard the law grants to the employee involved.
An employer's disciplinary authority is the right to penalize staff who breach the obligations imposed by law, the duties arising from an employment contract, or the rules set out in an institution's own regulations. The relationship between employee and management is, in effect, a two-way discipline: staff must honor their legal and civil-service duties, while management must apply every legal requirement governing personnel affairs before any penalty is issued.
